Terms of Use

What you get, what you pay for, and what is down to each of us.

Apply to BeatLevels for Android (com.emagombe.beatlevels).

The short version

BeatLevels plays the music you already have. Listening is free; Pro is a one-time purchase through Google Play that adds to the app and never takes music away. There is no account, no subscription and no advertising.

Nothing in these terms takes away the rights the law of your country gives you as a consumer.

Who you are dealing with

BeatLevels is developed and sold by its developer, who is declared to Google Play as a trader. The developer’s name, address and contact details are shown on the app’s Google Play page. In these terms, “we” means that developer and “you” means the person using the app.

By installing or using BeatLevels you agree to these terms. If you do not agree, please do not use the app.

Your licence to use the app

We give you a personal, non-exclusive, non-transferable licence to install and use BeatLevels on the devices you use. The app is licensed to you, not sold: we keep every right in it, including its name, its design and its code.

You may not:

  • copy, sell, rent or redistribute the app, or publish modified versions of it;
  • remove or get around the Pro unlock, or share anything that does;
  • decompile or reverse-engineer the app, except where the law or the open-source licences below allow it.

BeatLevels is built partly from open-source components, listed with the full text of their licences in the app under Settings → About BeatLevels → Open-source licenses. Each stays under its own licence, and nothing in these terms restricts what that licence allows. In particular, FFmpeg and SoundTouch are under the LGPL: you may replace them with versions of your own, and reverse-engineer the app as far as is needed to debug such a change.

That exception is about those two libraries: it does not allow the rest of BeatLevels’ code to be copied, reused or redistributed.

Your music and your files

BeatLevels plays files that are already on your device, or that you choose to open with it. It does not sell, stream or supply music. Having the right to the files you play, and to the way you use them, is your responsibility.

Two actions change your files on purpose, and BeatLevels only does either when you ask it to: editing tags rewrites the file, and deleting a track removes it from your device. The app cannot undo either. Keep a copy of anything you cannot replace.

What is free, the trial, and Pro

Playing your music — the library, playlists and the queue — is free, and so are the equalizer’s factory presets and the bass and treble controls. Pro adds the features the app marks as Pro, and the app shows which those are before you buy.

A new install starts with 14 days with everything unlocked. When the trial ends, the free features keep working and your settings stay saved; the Pro features pause until you unlock them.

Pro is a one-time purchase, not a subscription, and it does not expire. It belongs to the Google account that bought it, and “Already bought it — restore” brings it back on any device signed in to that account.

BeatLevels changes with its updates: features are added, improved and sometimes reworked, free and Pro alike.

Payment and refunds

Purchases go through Google Play and are processed by Google, under Google Play’s terms. We never see your payment details. The price is the one Google Play shows you before you confirm, in your currency and with any taxes that apply where you live.

Refunds go through Google Play and its refund policy; you can ask for one from your Google Play order history. If Pro does not work as it should, write to us: we will help you get it working, and if we cannot, you are entitled to your money back.

If a purchase is refunded, Pro is removed from that Google account. Your settings stay saved, as they do when the trial ends.

Privacy

BeatLevels collects no personal data, and your music library never leaves your device. The details — including the one time the app uses the network — are in the Privacy Policy.

What we can and cannot promise

We work to make BeatLevels reliable, and we fix what is reported to us. But it is provided as it is: we do not promise it will be free of errors, run on every device, play every file or be available forever. Android, Google Play and your device are outside our control.

The equalizer and effects can make music louder. Listen at a safe volume — loud sound over long periods can damage your hearing — and remember that not every speaker or pair of headphones can take a large boost.

As far as the law allows, we are not liable for indirect or consequential loss, or for lost files or data, and our liability is limited to what you paid for Pro. None of this limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.

Ending this agreement

You can end this agreement at any time by uninstalling the app. We may end your licence if you break these terms — for example, by distributing a version altered to get around the Pro purchase.

If BeatLevels is ever withdrawn from Google Play, copies already installed are not switched off: the app has no server to switch off.

Changes

If these terms change, the date at the end of this page changes with it. Changes are not retroactive: a purchase is governed by the terms in force when it was made. If you want the version that applied on a particular date, ask and we will send it to you.

Your rights as a consumer

If you use BeatLevels as a consumer, you keep every right the consumer law of your country gives you, and these terms do not limit any of them — wherever something here seems to, the law prevails.

If something goes wrong, write to us first. Most problems are solved faster by e-mail than by anything else.
